Payment Agreement

Article 1. Overview

This Payment Agreement applies to the purchase of in-game currency, or GameFuse tokens, of Internet-based onlinegames serviced by (US), LLC. (the “Company” or “CHANGYOU”) through its website at and all sites that are operated by CHANGYOU associated with such URL (collectively, the “Website”). This Payment Agreement is in addition to, and does not in any way replace or supplant, the End User License Agreement that may have accompanied the CHANGYOU software (the “EULA”) and to which the CHANGYOU software is subject and the Terms of Service available at the Website. If there is any conflict between the terms of this Payment Agreement and the Terms of Service, the Terms of Service shall control. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other CHANGYOU services, affiliate services, third-party content or third-party software.

Article 2. Effect of Agreement; Changes

  1. Any purchase of platform tokens signifies your acceptance of the Payment Agreement. This is a legal agreement between you and CHANGYOU. You hereby represent that you have the legal capacity to enter into this Payment Agreement, and that you are not barred from purchasing platform tokens offered by the Website under the laws of the United States or other applicable jurisdiction.
  2. CHANGYOU may, from time to time, modify, amend, or supplement its fee and billing methods and/or this Payment Agreement, and post those changes on the Website. Such modifications, amendments or supplements shall be effective immediately upon posting on the Website. If any change is unacceptable to you, you may cancel your account at any time, but CHANGYOU will not refund for any platform tokens or in-game points remaining on your account upon such cancellation. The Company will not be responsible for any failure on your part to read and understand any modifications, amendments or supplements posted on the Website.

Article 3. Use Subject to Term of Use and U.S. Law

All situations not clearly covered by this Payment Agreement will be subject to the Terms of Service and applicable laws of California, United States.

Article 4. Payment Options

The Company may suspend approval or reject any transaction for the following reasons:

  1. The user is not a registered member;
  2. Payment cannot be verified;
  3. Suspected fraud or violation of Payment Agreement, Terms of Service and/or EULA of CHANGYOU or U.S. laws; or
  4. The Company determines at its sole discretion that accepting such transactions will adversely affect the Company, the games, or the users of the games.

Choice of Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without reference to principles of conflict of laws.

Charging Instructions:

If you are under age 18, you must review this Payment Agreement with your parent or guardian before accepting the terms of this Payment Agreement and get permission from your parent or guardian to purchase CHANGYOU platform tokens. Failure to do so may result in suspension or termination of your account.
